Terms of Use

These Terms of Use apply to the supply of any activities whether booked by you on our website, directly with a member of staff or via the venue/school where the activity takes place. This includes camps, clubs, courses, events, swimming and other activities (each an ‘Activity’) and supplied by a member of The Active Academy. No other terms apply, other than the descriptions of the Activity which are to be found on our website and any other terms to which reference is made in these terms of use.


By booking an Activity with The Active Academy you are acknowledging your full acceptance of these Terms of Use and confirming that you have not relied on any term other than those contained within these Terms of Use. Activities include Clubs, Classes, Camps, Swimming or other services provided by The Active Academy.

By using our website, you confirm your acceptance of those parts of these Terms and Conditions which are applicable to use of our website.

BOOKING AN ACTIVITY

Upon receipt of a completed booking form and full payment from you, we will confirm your booking via the email address you have provided.


Before booking please ensure you or your child is available to attend the Activity and meets the conditions for participation in the Activity, as listed on our website.

You are entitled to cancel a booking and receive a full refund up to fourteen (14) calendar days before the start of an Activity. After this period, due to staffing arrangements, we are unable to offer any refunds, either in whole or in part.

Individual days within a block booking cannot be refunded, only the full block in its entirety.


Once the Activity has started, refunds and transfers are not offered under any circumstances.

CLASS CANCELLATIONS

You may reschedule an individual class up to 24 hours before the start time. Cancellations after this period will still be charged. We do not offer refunds for individual classes.

TRANSFERS

If required, you may transfer your Activity place to another suitable person or child. Transfers can only take place before the start of the Activity. We do not issue refunds for transfers, you are responsible for organising any payments from the transferring person.


You must notify us of any transfers at least 48 hours before the start of the Activity by emailing hello@the activeacademy.co.uk


PROGRAMME CHANGES OR CANCELLATIONS

In the event that we have to cancel an Activity for any reason, we will offer alternative provision of the Activity to you.


If you notify us prior to the start date of the re-arranged Activity that you would prefer a refund then we will refund to the person who booked the full value of the amount paid for the Activity.


In the event of inclement weather, suitable indoor activities will be organised to replace the outdoor activities, at the discretion of our staff.


SAFEGUARDING & CHILD PROTECTION

All our staff hold current child protection and Safeguarding qualifications and a current Enhanced Disclosure and Barring Service (DBS) check certification. If a child complains of abuse, or a member of staff believes that the child is suffering from abuse, we will act in accordance with our Safeguarding Policy. See links below.


MEDICAL INFORMATION

Any relevant medical conditions of the person attending must be fully disclosed in writing at the time of booking and to the Activity Professional before the Activity begins.  If a medical condition is not disclosed in this way, then The Active Academy will not be responsible where the steps taken by it (or not taken) would have been different if the medical condition had been disclosed.


The Active Academy can only administer medication in an emergency and then only where a member of staff with an appropriate level of qualification is present at the emergency.


HEALTH & SAFETY

A full risk assessment will be carried out by us in respect of each Activity.


All Activity Professionals involved in the provision of the Activity hold at least a current Emergency Aid Certificate issued by an appropriate body.


By agreeing to these terms of use, you provide consent for us to administer all necessary first aid as required at any time.


You must ensure that you or your child complies with our safety procedures, including the following:

  • Earrings must not be worn during an Activity (except that newly-pierced ears may be covered with appropriate tape or fitted with a plastic retainer from a reputable jeweller).

  • Clothing and footwear appropriate to the Activity must be worn throughout the Activity.


We reserve the right to exclude anyone from the Activity if the above requirements are not met in full.


LEAVING AN ACTIVITY

Each child must be collected by a parent or guardian unless express written consent has been given prior to commencement of the Activity, confirming that the child may leave alone. The parent or guardian must ‘sign out’ each child on collection, with an Activity Professional.


FILM/PHOTOGRAPHY

We may from time to time take photographs/video of the Activity for promotional and publicity purposes. These images may be used for promotional purposes on printed material, websites and social media.

You will be given the opportunity as part of the booking process to consent to the taking of such photographs/film of you or your child.  No photograph/video including you or your child will be published without your express consent. We ask for consent for each activity you or your child participates in.

You may withdraw your consent at any time by emailing hello@theactiveacademy.co.uk. We will make every effort possible to remove previously published images (where consent was previously given) but this may not always be possible.

PERSONAL BELONGINGS

We do not accept responsibility for loss or damage to personal belongings whilst attending an Activity. You are responsible for ensuring that no valuables (including devices) are brought to the Activity by your child.


CODE OF CONDUCT

We expect everyone to behave in a kind, respectful and appropriate manner while participating in any of our Activities. Children or adults who continue to display inappropriate behaviour during the Activity will not be allowed to participate for some or all of the session.


Inappropriate behaviour includes but is not limited to: inappropriate language, overly physical behaviour and inappropriate contact with other participants or staff, reluctance to follow or listen to instruction, defiance and non-compliance, unkindness or bullying.

COMPLAINTS

In the unlikely event that you or your child is dissatisfied with the service we provide then please in the first instance raise it with the Activity Professional on the Activity. He/she will deal with the problem in accordance with our policies and procedures.


If the problem is not resolved to your satisfaction then please contact use at hello@theactiveacademy.co.uk within 7 days of your child’s attendance at the Activity.

We take your views and complaints very seriously and will endeavour to resolve your complaint as quickly as possible. However, refunds will only be issued if we are in breach of our Terms of Use.


INFORMATION

The information on this site is updated regularly. However, where we may include information provided by third parties on our site and link to third party websites and do not accept responsibility for such third party materials.


We (or third parties) own the content on our site; you should only use this content for considering our services and making a booking (and for any other specific purposes that we make clear on the site).


For more information as to the personal data that we collect from you and what we do with that personal data, please see our Privacy Notice, which forms part of these Terms of Use.


If any term within these Terms of Use is found to be unenforceable by a competent court, then the term shall be deleted but the remaining terms shall continue in force to the full extent permitted by law.

These Terms of Use are governed by English law and subject to the exclusive jurisdiction of the Courts of England.  If you live in Scotland, you can bring legal proceedings in respect of the products in either the Scottish or the English courts. If you live in Northern Ireland, you can bring legal proceedings in respect of the products in either the Northern Irish or the English courts.
